Agreeing to these terms

These terms are an agreement between you and MONKE BUSINESS INC ("we") about the maku apps for iPhone and Android, the server they use, and the website at maku.fit. By using maku you agree to them. If you don't agree, don't use maku. Our privacy policy says what we do with your data.

Who can use maku

You can use maku without an account. Chat with the monke is for players 13 and over. When you open Chat the app asks your age, and you agree to answer truthfully. If you answer under 13, Chat stays closed and the rest of maku stays available. Apple and Google may set their own age rules for downloading apps, and those apply too.

Your account

The first time you open maku, the app makes an anonymous player for your phone. You can add an email address, so you can sign in on another phone and keep your monke. Keep your phone and email safe. What happens under your player is your responsibility, and you can write to us if you think someone else has access. You can delete your account in the app, under Profile, Account, as the privacy policy describes.

Acceptable use

When you use maku you agree not to:

• give your monke a name, or write a chat message, that is hateful, harassing, sexual, or breaks the law, or that pretends to be someone else;
• harass other players, or try to add players who have blocked you;
• guess friend codes, event codes or station codes, or scan codes you were not given at an event;
• fake your activity to earn coconuts, for example by sending steps or workouts that did not happen, using more than one account to collect rewards, or using a script or modified app;
• use the server in any way other than through the maku apps, including sending requests in bulk, probing for weaknesses, or trying to read other players' data;
• copy, reverse engineer or resell the apps or the website, or work around any limit we set.

Coconuts and active days follow what your phone measures. Time you say you spent counts for nothing on its own, and activity you typed in by hand pays nothing unless we turn that on. We may change a limit or take back coconuts or items earned unfairly, and we may do it without notice.

Friends

A friend can see your monke's name, its stage and look, and how many daily quests you finished today. Pick a name you are comfortable having others read.

Events

At an event the public booth page can show your monke's name and event coconuts. We may change a name or remove a player from an event or a leaderboard if it breaks these rules. Prizes are at our discretion and may need an email address from signing in.

The monke is an AI

Your monke's chat replies are written by an AI model. The monke is not a person. It can get things wrong, and it can say things that sound sure and are not true. It does not give medical, mental health, legal, financial or other professional advice, and nothing it says replaces a doctor, a therapist or any other professional. A reply is not a diagnosis, a treatment or a plan for your health.

If you are in danger now, call your local emergency number. You can also find a help line near you at findahelpline.com. maku is not a crisis service and does not watch chats in real time.

Chat is usually limited to 25 messages a day, and you can stop at any time. Replies are produced by MiniMax, a company that is not us, and the privacy policy says what it receives. Don't type anything into Chat that you don't want it to receive.

Health disclaimer

maku is a game. It is not a medical device and does not diagnose, treat or prevent anything. The numbers it shows, such as steps, exercise minutes, sleep and fitness levels, come from your phone and from Apple Health or Health Connect, and they can be wrong. Talk to a doctor before you start or change an exercise routine, especially if you have a health condition. Listen to your body, stop if something hurts, and don't push yourself for a game. A quiet day can lower an adult's fitness level, but your monke never dies and survival never needs exercise.

Virtual items

Coconuts and items such as poses, backdrops and outfits are earned in the app. They have no cash value. You can't sell them, trade them, give them to another account or exchange them for money, and they are not your property. We can change prices, rewards and what is in the shop, or remove an item, at any time. If we delete or reset an account, the coconuts and items in it go too.

Your content

Your content means your monke's name and your chat messages. You keep what you wrote. You give us permission to store it, show it to the people described above, and send it to MiniMax to write replies, so that maku can work. You promise that you have the right to use what you write and that it follows these rules.

What we own

We own maku, or have the right to use it: the app and website code, the art, the sounds, the monke characters, the shop items and the MNKD collection, the words in the app, and the names maku and MNKD. We give you a personal, limited license to use the apps for your own enjoyment, and it ends when these terms end. Don't use our names, art or sounds for your own products or in a way that suggests we back you. If you send us feedback or ideas, we may use them without owing you anything.

Third-party terms

You download maku from Apple's App Store, Google Play or a test program such as TestFlight, and their terms apply to those downloads. Health data comes from Apple Health or Health Connect under their terms. Apple and Google are not parties to these terms and are not responsible for maku or for support. Your phone carrier may charge for data.

Changes

We may update these terms, and we will change the date at the top when we do. If a change matters to how you use maku, we will say so in the app before it takes effect. If you keep using maku after the date, you accept the new terms. We may also change, pause or end any part of maku, or maku as a whole.

Ending your use

You can stop using maku at any time and delete your account in the app. We may suspend or end your access if you break these terms or if we have to by law. We may also end the service. When an account ends, its data is deleted as the privacy policy describes. The parts of these terms that must survive to make sense, such as what we own, the disclaimers, the limit on liability and the California law, survive.

No promises about maku

maku is provided as it is and as it is available. We don't promise that it will always work, be free of errors, keep your data forever, or fit a particular purpose. It is still in testing, so a monke or a score may be lost, reset or changed. To the extent the law allows, we are not responsible for what comes from the AI's replies, or for anything that happens because you relied on the game's numbers.

Limit on liability

To the extent the law allows, MONKE BUSINESS INC and the people who work for it are not liable for indirect, incidental, special or punitive losses, or for lost data, profits or goodwill, arising from your use of maku. Our total liability to you for anything related to maku is limited to the amount you paid us to use it in the last 12 months. maku has no purchases at the moment, so that amount is zero. Some places don't allow these limits, so they may not apply to you, and nothing here limits a right you have by law that can't be waived.

California law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute about these terms or maku goes to the state and federal courts located in California, and you and we agree to their jurisdiction.
